Is it legal to use photoshopped screenshots of video games with intent to make money?

Are there legal issues with creating a gaming website where one may sell in game virtual items, or CD Keys for the specific game (Diablo II for example). In order to display the items themselves and some graphics to decorate the website, screenshots from the game have to be made. Is it legal then to photoshop these images and later upload them to your website in banners and such with the intent to use it for monetary gain?

Yes, it is copyrighted material and you open yourself up to being sued. If you use copyrighted material for financial gain then the owner can sue you.
